Court Throws Out Aiyedatiwa’s Bid to Amend Re-election Eligibility Case
Lucky Aiyedatiwa has lost his bid to challenge an amendment in a lawsuit questioning his eligibility to contest the next governorship election in Ondo State.

The Court of Appeal sitting in Abuja dismissed the governor’s appeal, ruling that it lacked merit. The appellate court thereby upheld the earlier decision of the Federal High Court which allowed the plaintiff to amend the originating summons in the case. 

The suit was filed by an APC chieftain, Akindele Egbuwalo, who asked the court to interpret Section 137(3) of the Nigerian Constitution regarding the eligibility of Aiyedatiwa and his deputy, Olayide Adelami, to contest for another term in office. 

In its ruling, the three-member panel of the appellate court held that the governor failed to prove that the lower court denied him fair hearing when it permitted the amendment to the suit. The court therefore affirmed the Federal High Court’s decision delivered on November 24, 2025, which granted the request to amend the originating processes. 

The Court of Appeal also dismissed another application filed by the governor seeking to set aside an earlier order staying further proceedings in the matter before the Federal High Court. 

The ruling means the substantive suit challenging Aiyedatiwa’s eligibility to contest the next governorship election in the state will proceed at the Federal High Court in Akure.
